1. Agreement to these Terms
These Terms of Service govern your use of the Kept website at keptdaily.app and of the Kept application and related services (together, Kept). By using Kept you agree to these Terms. If you do not agree with them, please do not use Kept.
2. Who we are
Kept is operated by Kept Studio, based in Brazil. You can reach us at any time at hello@keptdaily.app, and that is the correct address for every question, request or complaint about these Terms, about your account or about your data.
3. What Kept is
Kept is a prayer journal and daily devotional. It lets you write down what you are praying for, follow those prayers over time, mark them as answered and record how they were answered. It also offers written and audio devotional content built around Scripture.
Kept is a personal devotional tool. It is not a church, it is not pastoral care, and it does not provide religious counselling, medical care or psychological treatment.
4. Current status of the service
Kept has not launched yet. At present this website presents the product and lets you ask to be told when it opens, by writing to us. There are no accounts, no subscriptions and no purchases available today. The sections below describe the terms that will apply to the Kept application when it becomes available, and they are published now so that you can read them before you ever decide to sign up.
5. Eligibility
You must be at least 18 years old to create a Kept account. Kept is not directed to children and we do not knowingly allow anyone under 18 to register. If we learn that we hold an account belonging to a minor, we will delete it and the data associated with it.
6. Your account
Creating an account requires a valid email address. You are responsible for keeping your login credentials confidential and for the activity that happens under your account. Please tell us promptly at hello@keptdaily.app if you believe your account has been accessed by someone else.
7. Subscriptions, billing and Paddle
Paid plans for Kept are sold and processed by Paddle.com Market Ltd, which acts as the merchant of record for every purchase. This means that Paddle, not Kept Studio, is the seller of the subscription, that Paddle handles the payment, and that Paddle is responsible for charging and remitting sales tax, VAT and GST where they are due.
Your purchase is therefore also subject to Paddle’s own buyer terms, and your payment receipt and invoices come from Paddle. Kept Studio never receives or stores your full card number. Prices, currency, billing period and any applicable tax are shown to you at checkout before you confirm.
8. Free trial
Kept may offer a free trial that requires a valid payment method. If you do not cancel before the trial ends, the subscription begins and the first payment is taken. We will send a reminder by email before any first charge, and the trial period and its end date are shown to you when you start it.
9. Renewal and cancellation
Subscriptions renew automatically at the end of each billing period, for the same period, until you cancel. You can cancel at any time, from inside the application or by writing to hello@keptdaily.app. Cancellation stops the next renewal. Your access continues until the end of the period you have already paid for.
Cancelling never deletes your prayers. Your journal is preserved. If your subscription ends, synchronisation and paid content stop, but the content you wrote remains yours and remains stored, and it becomes available again if you return.
10. Refunds
Because Paddle is the merchant of record, refunds are handled through Paddle under its refund policy. Independently of that, if Kept did not work as described for you, write to hello@keptdaily.app and we will deal with it fairly. Where consumer law gives you a right of withdrawal or a statutory refund right, that right applies and nothing in these Terms limits it.
11. Price changes
We may change the price of a plan. Any change is announced by email in advance and applies only from your next billing period, never retroactively. If you do not accept a new price, you can cancel before it takes effect.
12. Your content: your prayers
Everything you write in Kept, including prayers, notes, categories and the record of how a prayer was answered, belongs to you. We claim no ownership of it.
You grant us only the narrow, revocable permission we need in order to run the service for you: to store your content, to encrypt it, to back it up and to transmit it between your own devices so that your journal appears on each of them. That permission exists for no other purpose. We do not publish your content, we do not sell it, we do not share it with advertisers, and we do not use it to train artificial intelligence models, ours or anyone else’s. You can export your journal, and you can delete your account and its content.
13. Scripture and other third-party content
Biblical text in Kept is taken from translations in the public domain: the World English Bible in English and the Reina-Valera 1909 in Spanish. Devotional writing, audio and design in Kept are our own work and are protected by copyright. You may use them for your personal devotional use. You may not copy, redistribute or resell them.
14. Features that use artificial intelligence
Some Kept features may use artificial intelligence to help compose a written prayer from a theme you choose. Where that happens it is disclosed in the application. Two limits always apply. First, generated text is a devotional aid and not a statement of doctrine. Second, the system never writes, paraphrases or invents biblical text: it returns only a reference, and Kept inserts the published wording of the translation. Your journal is not used to train these models.
15. Acceptable use
You agree not to:
- break the law or infringe anyone else’s rights using Kept;
- attempt to access another person’s account, prayers or data;
- probe, disrupt or overload the service, or bypass any security or access control;
- copy, scrape, resell or redistribute paid devotional content or audio;
- share an account or credentials so that other people can reach paid content without a subscription.
16. Kept is not professional care
Kept is not a medical device and is not a substitute for professional help. It does not diagnose or treat anxiety, depression, grief or any other condition. If you are struggling with your mental health, please speak to a qualified professional. If you are in crisis or you are thinking about harming yourself, contact your local emergency service immediately. In Brazil you can reach the CVV on 188, free of charge, at any hour.
17. Availability and changes to the service
We work to keep Kept available and working, but we do not promise that it will be uninterrupted or error free. We may add, change or withdraw features. If we ever have to withdraw the service as a whole, we will give reasonable notice by email and provide a way to export your journal before it stops.
18. Suspension and termination
You can stop using Kept and delete your account at any time. We may suspend or close an account that breaches these Terms, and where it is reasonable to do so we will contact you first and give you a chance to put it right. If we close your account for a breach, you may still request an export of the content you wrote.
19. Disclaimers
Except for the commitments we make expressly in these Terms, Kept is provided as it is and as it is available. Nothing in this section excludes any warranty or right that the law does not allow us to exclude, including consumer rights under the Brazilian Consumer Protection Code.
20. Limitation of liability
To the extent the law permits, Kept Studio is not liable for indirect or consequential loss, and our total liability in connection with Kept is limited to the amount you paid us in the twelve months before the event that gave rise to the claim. Nothing here limits liability for fraud, for wilful misconduct, or for anything else that cannot be limited by law.
21. Changes to these Terms
We may update these Terms. The date at the top always shows the current version. If a change materially affects your rights, we will tell you by email before it takes effect, so that you can cancel if you disagree.
22. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil. If you are a consumer, you keep the protection of the mandatory consumer law of your own country of residence, and you may bring proceedings in the courts that the law makes available to you.
